We understand that your personal information is important to you and Valeur is committed to protecting your privacy. 


This Privacy Policy governs the manner in which the Valeur Group comprising Valeur Investments Pty Limited
(ACN 645 934 363) [1], Valeur Pty Limited (ACN 645 931 791) [2], and Auto Next Pty Limited (ACN 670 002 945 ) [3], and their associated entities (each a “Valeur Group Entity” and together "we", "us" or "our") collect, use, store, share and disclose your personal information. These entities collectively provide investment management, insurance agency, asset verification, and vehicle buyback services as described in this policy.


Personal information may be shared between Valeur Group Entities to facilitate our integrated business operations, service delivery, and administrative functions.


1.     Openness and transparency 

We are committed to protecting your privacy and respecting and upholding your rights under the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act).  We ensure that we will take all necessary and reasonable steps to comply with the APPs and to deal with inquiries or complaints from individuals about compliance with the APPs.  


By accessing and using our website, products and services, you agree to and consent to the collection, use, storage and disclosure of personal information by us as set out in this Privacy Policy. 


2.     Personal information 

Personal information is information or an opinion about an individual whose identity is apparent, or can be reasonably ascertained, from that information or opinion (whether true or not, and whether recorded in a material form or not).  


The kinds of personal information that we collect and hold about you will depend on the nature of your dealings with us. 


If you do not wish to provide us with your personal information, we may not be able to respond to your query, provide you with our products and services or assess your application or eligibility for a product or service.


The types of personal information we may collect include, but are not limited to:  

  • Contact information (such as your full name, company name and details, date of birth, address, email address, and telephone number);

  • Identification information (such as driver's license or passport details);

  • Vehicle information (such as make, model, year, VIN/serial number, registration details, purchase details);

  • Financial information (such as billing details, bank account details for processing payments, loan information);

  • User-generated content (such as reviews and feedback);

  • Your device ID, device type, geo-location information, computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information; 

  • Details of the products and services we have provided to you or that you have enquired about; 

  • Any additional information relating to you that you provide to us directly through our website or app or indirectly through your use of our website or app or online presence or through other websites or accounts from which you permit us to collect information;

  • Any credit card details that you provide us will be collected via a secure third-party payment processing platform which will process the payment. The third party will then provide us with confirmation of your payment. The third party does not share your credit card details with us;

  • Information collected from marketing campaigns, product research, customer surveys, your interactions with us including via social media; 

  • Insurance-related information (including policy details, claims history, risk assessments, and underwriting information collected through our insurance agency services);

  • Vehicle monitoring and valuation information (including ongoing vehicle condition assessments, depreciation analysis, market value data, photographs, and service records collected through our products and technology platform(s). This may include automated vehicle valuation, condition tracking, and optimal resale timing analysis conducted through our proprietary systems, and may be used to trigger customer engagement during relevant resale windows;

  • Financial arrangement information (including loan balances, financing details, and payment histories relevant to our products  and insurance products we provide to you)

  • Business partner and distributor information (including dealer details and referral source data);

  • Employment information (where you are an employee, contractor, or job applicant); and

  • Any other personal information that may be required in order to facilitate your dealings with us.

3.     Collection

We will collect personal information only by lawful and fair means and not in an unreasonably intrusive way.   


Generally, we will collect personal information directly from you, and only to the extent necessary to provide our products and services requested or ordered by you and to carry out our administrative functions or as required by law. 


We will collect your personal information directly from you when you interact with us, including via telephone, our websites and online applications, surveys, hardcopy forms or email. However, there may be occasions where we collect personal information about you from our distribution partners (such as vehicle dealers and finance companies) where they provide customer details in connection with our products, business partners, third parties or other sources.


We require individuals to provide accurate, up-to-date and complete personal information at the time it is collected.


4.      What do we do with your personal information?

We use and disclose your personal information for the purposes for which the information is collected, or for a directly related purpose, including (but not limited to): 

 

  • Providing our website, products and services to you; 

  • Assessing, administering, protecting, improving or optimising our website, products and services (including performing data analytics, conducting research and for advertising and marketing purposes); 

  • Informing you about our website, products, services, rewards, surveys, contests, or other promotional activities or events sponsored or managed by us or our business partners; 

  • Managing your account, dealing with enquiries, responding to complaints and processing payments you have authorised;

  • Verifying your identity and asset (for example vehicle); 

  • As part of customer testimonials that we may publish (including on social media), with your consent;

  • Auditing, quality assurance and training;

  • Providing insurance agency services on behalf of insurers we may act for;

  • Administering contracts you may have with us including eligibility assessment, ongoing vehicle value monitoring, optimal upgrade timing analysis, and contract administration;

  • Conducting asset verification and authentication services (including through our technology platforms);

  • Facilitating distribution partnerships with vehicle dealers, financiers, and other business partners;

  • Risk assessment and underwriting for insurance and financial products;

  • Claims management and investigation;

  • Regulatory reporting and compliance with insurance, financial services, and corporations law requirements;

  • Group administration including inter-company loans, shared services, and consolidated reporting;

  • Any other purpose you have consented to; and 

  • Any use which is required or authorised by law. 


5.     Disclosure of personal information

In order to carry out our functions and activities, including to facilitate our business operations or to provide you with a product or service, we may need to share your personal information. 


Sharing your personal information may include collecting your personal information from, transferring your personal information to, or otherwise making your personal information visible or accessible to, one or more of the following parties and sources: 


Within the Valeur Group:

  • Between Valeur Group Entities for integrated service delivery, support services, consolidated reporting, and to facilitate the provision of insurance, vehicle buyback and verification products, administrative services, consulting services and technology platform operations.

  • To Valeur Group employees, contractors, and authorised representatives


Insurance and Financial Services Partners:

  • Our insurers and insures we may act for in relation to policy administration, underwriting, and claims

  • Reinsurers, insurance brokers, and underwriting agencies

  • Financial institutions, lenders, and credit providers


Distribution and Business Partners:

  • Vehicle dealers, manufacturers, and distributors participating in our programs

  • Financing companies and leasing providers

  • Asset recovery and remarketing agents


Professional Service Providers:

  • Legal advisors, accountants, auditors, and other professional consultants

  • Debt collection agencies and enforcement agents

  • Vehicle assessors, valuers, and inspection services

  • IT service providers, data processors, and cloud storage providers

Regulatory and Legal:

  • Australian Prudential Regulation Authority (APRA), Australian Securities and Investments Commission (ASIC), and other regulators

  • Courts, tribunals, and law enforcement agencies

  • Any person or entity as required or authorised by law

  • If the ownership or control of any of businesses changes, we may transfer and disclose your personal information to the new owner.

6.     Access to and correction of your personal information

You can request access or correction of your personal information that we hold by contacting us. 

 

We may ask you to complete a personal information access request form to help us process your request quickly and help us gather information necessary to verify your identity. 


There is no charge for requesting access to your personal information, but we may charge you a reasonable amount to cover matters such as retrieving, copying and sending out information.  


We will respond to your requests to access or correct your personal information in a reasonable time.  


There are some circumstances in which we are not required to give you access to your personal information. We'll let you know if we are unable to give you access if it is practical and reasonable to do so.  


If we do not think that the personal information that we hold about you needs correcting, we will provide you with our reasons for not correcting the information. 


If we no longer need your personal information for any of the purposes set out in this Privacy Policy, or as otherwise required by law, we will take such steps as are reasonable in the circumstances to destroy your personal information or to de-identify it. 


7.     Direct Marketing 

We may use your personal information for direct marketing where:

  • You have provided express consent;

  • You have provided implied consent through your relationship with us; or

  • We are otherwise permitted by law (including under the Spam Act 2003). 


Our marketing communications may include:

  • Information about our products, insurance products, and related services;

  • Joint promotions with vehicle dealers, manufacturers, and financing partners;

  • Invitations to industry events and educational seminars;

  • Market research and customer satisfaction surveys;


and may be sent to you using any contact details provided by you, such as post, telephone, email or SMS.
At any time you may opt out of receiving direct marketing communications from us. Unless you opt out, your consent to receive direct marketing communications from us and to the handling of your personal information as detailed above, will continue.  You can opt out by following the unsubscribe instructions included in the relevant marketing communication, or by contacting us in writing at privacy@valeur.io. Your opt-out will apply across all Valeur Group entities.


Digital Marketing: We may use digital advertising platforms (including Facebook, Google, LinkedIn, and other social media platforms) to promote our products via targeted advertisements to our existing customers and customers. This may involve sharing limited personal information (such as email addresses in encrypted form) with these platforms to deliver relevant information. We take steps to ensure this sharing is secure and compliant with privacy laws.


You can manage how your personal information is used for advertising by adjusting your preferences in the settings of the digital platforms you use (such as Facebook, Google, or LinkedIn). Most platforms offer tools to manage ad preferences and limit targeted advertising. Where we use digital advertising platforms, your information may be securely hashed and matched to platform user records to serve you relevant ads. You can opt out of this use by contacting us or managing your ad preferences through the relevant platform.

8.    Cross-border disclosure

We may disclose personal information to overseas entities for our business operations, including:

  • United States: Some of the insures we act for and some insurance we obtain is provided by US based providers Insures. We also use US-based service providers for technology and business services.

  • Other countries: Service providers in Europe, Asia, and other jurisdictions for technology, professional services, and business operations.


These disclosures are necessary for our insurance coverage under our agreement with our insurers for contract administration, and efficient service delivery.


By using our services, you acknowledge and consent to these overseas disclosures. You understand that overseas recipients may not be subject to Australian privacy laws and you may not be able to seek redress through Australian privacy complaint mechanisms.


We take reasonable steps to ensure overseas recipients handle your personal information appropriately, including through contractual arrangements such as data processing agreements and standard contractual clauses where applicable.


Despite overseas disclosure, you retain your rights under Australian privacy law to access, correct, and complain about our handling of your personal information.


9.     Website

When transmitting personal information from your computer to our website, you must keep in mind that the transmission of information over the Internet is not always completely secure or error-free. Other than liability that cannot lawfully be excluded, we will not be liable in any way in relation to any breach of security or any unintended loss or disclosure of that information. 


The website may use 'cookies' or other similar tracking technologies on our website that help us track your website usage and remember your preferences. Cookies are small files that store information on your computer, TV, mobile phone or other device. They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. You can disable cookies through your internet browser but if you do so, you may not be able to fully experience the interactive features of our website. 


10.    Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not controlled or operated by Valeur. This Privacy Policy does not apply to such third-party websites or services. We encourage you to review the privacy policies of those third parties before providing any personal information. 


11.    Security

We may hold your personal information in either electronic or hard copy. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure. We use appropriate physical, administrative, personnel and technical measures to protect your personal information.


However, we cannot guarantee the security of any personal information transmitted over the internet and therefore you disclose information to us at your own risk. 


In the event of a data breach likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required by law.

13.    Retention

We store, process, and retain your information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy. When we no longer need your information, we take reasonable steps to destroy or de-identify it, unless we are required or authorised by law to retain your information for a longer period.


14.    Your responsibilities

We take reasonable precautions to ensure that the personal information we collect, use and disclose is accurate, complete and up-to-date. However, the accuracy of that information depends to a large extent on the information you provide. To ensure the information we hold is accurate, complete, up to date and relevant, we require that you:

  • Let us know if there are any errors in your personal information; 

  • Keep us up to date with changes to this information such as your name and address; and

  • Notify us of the sale or transfer of your vehicle.


If you do not notify us of a sale or transfer of a vehicle, we may continue to send communications in relation to that vehicle to the last known registered owner in our records.


15.    Updates to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will post any updates on our website and indicate the effective date of the revised Privacy Policy. Your continued use of our products and services after the effective date constitutes your acceptance of the updated Privacy Policy.
